These Terms of Service (“Terms”) are an agreement between you and Cytek Solar Limited (“Cytek Solar”, “we”, “us”) for use of cyteksolar.com, including the shop, quote requests, account area, and information about solar and wind installations.
By using the site or placing an order you agree to these Terms and to our Privacy Policy.
1.Who we are
Cytek Solar Limited designs, supplies, and installs solar and wind energy systems for homes, businesses, NGOs, and public institutions in Kenya and the wider East African region. Registered office: The Mirage, Tower 2, M1 — Westlands, Nairobi. Contact: info@cyteksolar.com, +254 794 666 111.
2.Eligibility and accounts
You must be able to enter a binding contract under Kenyan law (generally 18 years or older) to create an account or place an order. You are responsible for keeping your login details confidential and for activity under your account. We may suspend or close an account that we reasonably believe is abused, fraudulent, or in breach of these Terms.
3.Acceptable use
You agree not to:
- Use the site for unlawful, harmful, or misleading purposes.
- Probe, scrape, or overload the site, or interfere with other users.
- Copy or reuse our content, product images, or branding except as allowed by law or with our written permission.
4.Quotes, pricing, and information
Website descriptions, calculators, and quote estimates are informational. A quote is not a binding contract until we confirm scope, price, and terms in writing (including after a site assessment where needed). Prices are shown in Kenya Shillings (KES) unless we say otherwise. We may correct obvious errors and update prices or stock. Custom and installed systems often depend on site conditions, approvals, and product availability.
5.Shop orders and payment
When you check out, you offer to buy the items in your cart at the stated price. We accept payment through Paystack (cards and supported mobile-money methods). An order is accepted when we confirm it and payment succeeds, or when we notify you that we cannot fulfil it and arrange a refund of amounts we have received.
You may request cancellation of an unfulfilled shop order by contacting us promptly. Once goods have been dispatched, prepared as a custom kit, or scheduled for installation, cancellation may no longer be possible or may involve restocking costs we will explain in writing.
6.Delivery and installation
We deliver and install across Kenya and, by arrangement, elsewhere in East Africa. Delivery windows are estimates. You must provide safe access, accurate site information, and any permissions needed for installation (including landlord or statutory approvals). Extra visits caused by incomplete access or inaccurate information may be charged. Risk in portable goods passes on delivery; title passes when we receive full payment, unless a financing agreement says otherwise.
7.Financing
We may advertise zero-interest payment plans (typically 12, 24, or 36 months) with a deposit of about 10% of the system cost. Those figures are illustrations. Financing is subject to approval, a signed agreement, and the product and installation scope we confirm. Missing payments may lead to suspension of support, recovery action, or other remedies in that agreement. “Own from day one” refers to use of the installed system, not necessarily unencumbered legal title before the plan is paid off — the financing documents control.
8.Warranties
Hardware is covered by the manufacturer’s warranty for that product, which we will pass through or help you claim. Our workmanship on installations we perform is warranted against defects in our labour for a period stated in your installation or handover documents. We do not give a blanket website warranty period that overrides those documents. Warranties do not cover misuse, unauthorised modification, poor maintenance, or damage from events outside our control.
9.Returns
Custom-designed and installed solar or wind systems are generally not returnable once work has started or equipment has been configured for your site. For unused, unopened portable products bought through the shop, contact us within 7 days of delivery. We will confirm whether a return, exchange, or repair applies. Return shipping and any restocking cost (if applicable) will be explained before you send goods back. Faulty goods are handled under the applicable warranty or the Sale of Goods Act and related Kenyan consumer law.
10.Intellectual property
The site, logo, photographs, copy, and software are owned by Cytek Solar or our licensors. You may view and use the site for personal or internal business evaluation of our products. You may not republish our content as your own.
11.Limitation of liability
Nothing in these Terms limits liability that cannot be limited under Kenyan law (including for fraud or death/personal injury caused by our negligence). Subject to that, we are not liable for indirect or consequential loss (including lost profits or business interruption), and our total liability arising from the site or a shop order is limited to the amount you paid us for that order. For installation contracts, the liability cap in that contract applies. The site is provided “as is”; we do not warrant uninterrupted or error-free access.
12.Indemnity
You agree to indemnify Cytek Solar against claims and costs arising from your misuse of the site, inaccurate information you provide, or your breach of these Terms, except to the extent caused by our negligence or wilful misconduct.
13.Governing law
These Terms are governed by the laws of Kenya. Courts in Nairobi have exclusive jurisdiction, without limiting any mandatory consumer forum that Kenyan law gives you.
14.Changes and contact
We may update these Terms from time to time. The “Last updated” date will change. Material changes to an existing installation or financing contract will be agreed in writing, not by website update alone.
